Privacy and Data Protection
From the 25th of May 2018 onwards the EU’s new privacy regulation (GDPR) will apply. In the meantime it is essential to become compliant. The GDPR changes many aspects of the current legislative framework, also in relation to financial information, financial services and applications because often personal data will be involved. Notably, rules on consent have changed, as well as rules on data security and the procedures for dealing with a data leak. Privacy policies and processor contracts (e.g. HR firms, IT providers, external data centers) will have to be adapted.
How do you make sure you are compliant while ensuring a maximal availability and use of your data?
Big Data in finance
Another legally hot topic is the use of big data in the industry. While the use of big data offers unseen possibilities, certain legal questions present themselves. How do you legally gather certain data sets? Is there free, specific and informed consent? Or is there another legal basis? How do you treat data sets containing personal data or a mix of personal and non-personal data? What uses are allowed? How do you define purpose restriction? How do you deal with sector specific regulation or sensitive data? Is the use of anonymised or aggregated data restricted by any legal rules? In short: are there any legal obstacles to your planned project?
Software agents and automated decision-making
Robotics in the financial sector is up and coming but raises many legal questions, of attributable and liability, of data protection and ownership of data, of IP ownership etc. Do you use software agents to give financial advice or to take autonomous decisions? Make sure these applications are legally compliant!
